Participant waiver, indemnity and assumption of risk for NativeChild Power Up Games 2026.

By purchasing a ticket to the NativeChild Power Up Games 2026, you acknowledge that you have read, understood, and agree to the following terms. This waiver, indemnity, and assumption of risk agreement is binding upon you, your heirs, executors, administrators, and assigns.

Assumption of Risk

The NativeChild Power Up Games is a community family fun day that includes physically demanding activities. By attending and participating, you acknowledge that the event includes, but is not limited to, the following activities:

  1. 8KM Power Run and 5KM Fun Run on designated routes
  2. Inflatable obstacle course (cargo net, leopard crawl, tyre challenge, gladiator track, knockdown, Wipe Out Big Ballers)
  3. Bubble soccer
  4. Power Pit (tyre flips, pull-up bars, battle ropes)
  5. Backyard Legends Zone (traditional playground and childhood games)
  6. Track sprints

You acknowledge and accept that participation in these activities carries inherent risks including, but not limited to, falls, collisions, muscle strains, sprains, fractures, heat-related illness, dehydration, and in rare cases, serious injury or death.

You voluntarily assume all risks associated with your participation in any and all activities at the event, whether or not specifically listed above.

Medical Fitness Declaration

By participating in any physical activity at the event, you confirm that:

  1. You are in good physical health and have no medical condition that would prevent safe participation.
  2. You have consulted a medical professional if you have any doubt about your fitness to participate.
  3. You will not participate in any activity while under the influence of alcohol, drugs, or any substance that may impair your physical or mental abilities.
  4. You will immediately cease any activity and seek medical assistance if you feel unwell, dizzy, or experience any pain or discomfort during the event.

Indemnity and Release of Liability

To the fullest extent permitted by law, you hereby indemnify and hold harmless NativeChild Africa (Pty) Ltd, Rallinca Media (Pty) Ltd, UJ Stadium, their respective directors, employees, agents, contractors, volunteers, sponsors, suppliers, and representatives (collectively referred to as the “Organisers”) from and against any and all claims, demands, actions, damages, losses, costs, expenses (including legal fees), and liabilities of any kind arising from or in connection with:

  1. Your participation in any activity at the event
  2. Any injury, illness, or death sustained during or as a result of the event
  3. Any loss of or damage to personal property during the event
  4. Any act or omission of any other participant, spectator, vendor, or third party at the event

This indemnity shall apply regardless of whether such claims arise from the negligence (excluding gross negligence or wilful misconduct) of any of the Organisers.

Medical Emergency Consent

In the event of a medical emergency during the event, you consent to receiving first aid, medical treatment, or emergency transportation as deemed necessary by the event medical team or emergency services. You acknowledge that any costs associated with medical treatment or emergency transportation will be your own responsibility.

Minors and Parental Consent

If you are purchasing a ticket on behalf of a minor (any person under the age of 18), you confirm that you are the parent or legal guardian of that minor and that you:

  1. Consent to the minor’s participation in all activities at the event
  2. Accept all the terms of this waiver, indemnity, and assumption of risk on behalf of the minor
  3. Accept full responsibility for supervising the minor at all times during the event
  4. Consent to medical treatment for the minor in the event of a medical emergency

The Organisers are not responsible for the supervision of minors at the event.

Photography and Content Consent

By attending the event, you consent to being photographed, filmed, and recorded by the Organisers and their appointed content creators. You grant NativeChild Africa (Pty) Ltd a perpetual, royalty-free licence to use any images, video, or audio recordings of you for marketing, social media, press, editorial, and future advertising purposes.

If you do not wish to be photographed or filmed, please notify event staff at the information desk on arrival.

Event Rules and Conditions

  1. The event is fully cashless. Card and digital payments are accepted at all vendor stalls. No cash will be accepted.
  2. There is no bag drop facility at the event. All personal belongings are your own responsibility.
  3. All tickets are non-refundable. Tickets are fully transferable. The person attending must present the ticket (printed or digital) at the gate. The name on the ticket does not need to match.
  4. No gate sales. All tickets must be purchased in advance online.
  5. You must follow all instructions from event staff, marshals, security, and emergency services at all times.
  6. The Organisers reserve the right to refuse entry to or remove from the event any person whose behaviour is deemed unsafe, disruptive, or offensive, without refund.
  7. The Organisers reserve the right to alter, postpone, or cancel the event due to circumstances beyond their control including, but not limited to, severe weather, safety concerns, or force majeure events.
  8. No alcohol, illegal substances, weapons, glass containers, or fireworks may be brought into the venue.
  9. No pets are allowed at the venue, with the exception of certified service animals.
  10. Participants in the 8KM Power Run and 5KM Fun Run must follow the designated race route and obey all marshal instructions. Running with headphones on public road sections is strongly discouraged for safety reasons.

Limitation of Liability

To the fullest extent permitted by law, the total liability of the Organisers for any claim arising from or in connection with the event shall be limited to the ticket price paid by the claimant. The Organisers shall not be liable for any indirect, consequential, or incidental loss or damage.

Governing Law

This waiver, indemnity, and assumption of risk agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with this agreement shall be subject to the jurisdiction of the courts of the Republic of South Africa.

Acknowledgement

By completing your ticket purchase, you confirm that:

  1. You have read and understood all the terms of this waiver, indemnity, and assumption of risk agreement.
  2. You voluntarily agree to all the terms set out above.
  3. You are at least 18 years of age, or if purchasing on behalf of a minor, you are the parent or legal guardian of that minor and accept these terms on their behalf.
  4. You understand that this agreement is legally binding and enforceable.
